Voice recording in control rooms

Uniper attaches great importance to the protection of personal data and undertakes to protect the data of persons who contact our control rooms by telephone. Uniper Kraftwerke GmbH, Luitpoldstr. 27, 84034 Landshut (“Uniper”) processes personal data that are collected when our control room is called by phone in accordance with the data protection laws and is thus the data controller. This Privacy Notice provides you with information on how Uniper handles information that is collected by Uniper during your call.

This Privacy Notice applies to all control rooms that refer to it.

1. Collection and processing of personal data

Personal data all all information about your identity, such as your name, your telephone number or your postal address. Unless you have agreed otherwise with Uniper, Uniper only collects simple personal data that are necessary to handle your call, such as your name, address, telephone number and other contact details. Uniper also records your call to our emergency phone number.

Such data are only collected when you provide them to Uniper, e.g. when you call us. Uniper only collects these data directly from you and not from other third parties. In this respect, the legal basis for processing is Article 6 (1) (d) GDPR for life-threatening situations and Article 6 (1) (f) GDPR for all other incidents.

2. Use and disclosure of personal data

Uniper uses your personal data to answer your enquiry, to clarify the facts of the case in the event of ambiguities or to defend against legal claims.

Uniper will not sell or otherwise market your personal data to third parties or pass it on for their advertising purposes. Depending on the circumstances, they may be disclosed to third parties such as government agencies and organisations with security responsibilities.

Uniper will only process your data within the European Union. Data transfers to third countries only arise in the context of the administration of IT systems in accordance with the regulations on commissioned data processing and only to the extent that a) the transfer is in principle permissible and b) the special conditions for a transfer to a third country are met, in particular the data importer guarantees an adequate level of data protection in accordance with the EU standard contractual clauses for the transfer of personal data to commissioned data processors in the context of commissioned data processing in third countries.

3. Duration of storage

Uniper will only store your personal data for as long as is necessary in connection with the incident you have reported. In addition, we will only store your data as far as this is necessary to comply with statutory retention obligations or for the duration of legal disputes in order to protect our legitimate interests. We will delete your data immediately if they are no longer required for the purposes mentioned.

4. Security

Uniper takes precautions to protect your personal data against loss, destruction, falsification, manipulation and unauthorised access. Data protection law are certainly observed.

5. Your rights

You have the right to obtain information free of charge at any time about your personal data stored by us, their origin and recipients and the purpose of data processing, as well as the right to correct, block or delete and transfer this data.

FURTHERMORE, YOU MAY OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS ARISING FROM YOUR SPECIFIC SITUATION, IF THE PROCESSING OF YOUR PERSONAL DATA IS CARRIED OUT ON THE BASIS OF ART. 6 (1) (F) GDPR.

You may request a copy of the data we hold about you. Uniper reserves the right to charge you a small fee for this if you make disproportionate use of this right. If you wish to transfer your data to another data controller, Uniper will provide you with the data you have transferred to Uniper in a machine-readable format free of charge.

In order to exercise your above rights, please send us, Uniper Kraftwerke GmbH as the data controller, a description of the data concerned and state your name and other identification data such as the time of your call. If necessary, Uniper will request further proof of your identity in order to protect your personal data from unauthorised access.
